RE: The tariff classification of a pin gage and/or plug gage from the United States.

Dear Mr. Meyer:

In your letter dated December 12, 2008, you requested a tariff classification ruling. No sample was provided, but you did provide an image of what appear to be multiple short cylinders in a box.

You state: The article is a 2.0” long E52100 bearing quality steel rod with a precision outside diameter. Common uses are measuring hole sizes and depth, Go/NoGo gaging, and checking distance between holes in parts.

Harmonized System Explanatory Note D-5 to its 90.17 states: Gauges without adjustable devices, used only for sizing parts or checking angles, forms, etc. (for example, plug gauges, ring gauges), are excluded (heading 90.31).

The applicable subheading for these gages will be 9031.80.8085, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “other”, non-“optical” measuring or checking instruments, appliances and machines, not specified or included elsewhere in HTSUS Chapter 90. The rate of duty will be 1.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
