RE: The tariff classification of an Antenna Distribution System from an unspecified country

Dear Mr. Walsh:

In your letter dated December 3, 2008, you requested a tariff classification ruling on behalf of your client, Shure Incorporated.

The merchandise subject to this ruling is an Antenna Distribution System. Your letter states that the Antenna Distribution System is currently manufactured by Shure in Wheeling, IL. Your letter also states that you will encounter future entries of this merchandise. However, your letter did not specify the country or countries that future importation of this merchandise will come from. Therefore, we have not specified a particular country or countries that future importations of this merchandise will be coming from.

The Antenna Distribution System is identified in your letter as the Shure Model UA 845 UHF. The system consists of an antenna, amplifiers, AC power input connectors, power distribution panels, radio frequency (RF) connectors, and 12 volt DC connectors. It is an ultra high frequency (UHF) transmission system that expands a wireless microphone system by splitting one pair of antennas, which are used by up to four wireless receivers, to multiple wireless receivers. The system can also amplify radio frequency signals. In addition to its reception capability, it is also capable of transmitting voice, images and other data. A sample was furnished for classification purposes and is being returned as per your request.

You suggested that the Antenna Distribution System was classifiable under subheading 8517.69.0000 of the Harmonized Tariff Schedule of the United States (HTSUS). Subheading 8517.69.0000 provides for apparatus for transmission or reception of voice, images or other data. However, the Antenna Distribution System is apparatus which is capable of transmitting and receiving voice, images or other data, which is classifiable under subheading 8517.62.00. As such, subheading HTSUS 8517.69.0000 is inapplicable.

The applicable subheading for the Antenna Distribution System (Shure Model UA 845 UHF) will be 8517.62.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Machines for the reception, conversion and transmission or regeneration of voice, images or other data, including switching and routing apparatus: Other”. The rate of duty will be free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Linda M. Hackett at (646) 733-3015.

Sincerely,
