RE: The tariff classification of Finasteride (CAS-98319-26-7) in dosage form, from India
Dear Mr. Moynihan:
In your letter dated December 1, 2008, you requested a tariff classification ruling.
The subject product, Finasteride, is a medicinal preparation in tablet form containing Finasteride, a synthetic antiandrogen, as the active ingredient. It is used for the treatment of benign prostatic hyperplasia (BPH) in low doses, and prostate cancer in higher doses. It is also used for the treatment of androgenetic alopecia (male-pattern baldness).
The applicable subheading for the Finasteride in dosage form will be 3004.39.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses (including those in the form of transdermal administration systems) or in forms or packings for retail sale: Containing hormones or other products of heading 2937 but not containing antibiotics: Other: Other.” The rate of duty will be free.
