RE: The tariff classification of the 3-in-1 Game Table from China

Dear Ms. Quintana:

In your letter dated November 20, 2008, you requested a tariff classification ruling on behalf of The Sports Authority.

The 3-in-1 Game Table is a combination game table that when assembled measures 72” long x 36” wide. A photograph was submitted in lieu of a sample. The product consists of a table base supported by legs upon which different playing surfaces may be placed. The game table is equipped with a permanently affixed top and side leaves that allow the top to flip and lock into place so one can choose which game to play. One surface is a billiard table that when flipped over converts to an air hockey table with a 110 volt motor to power the fan for the air hockey play function. The product also is equipped with a table tennis board that may be placed atop the billiard table surface for table tennis play. The retail package includes a billiards ball triangle, cues, balls, cue stick chalk, 2 air hockey discs, plastic hand paddles, 2 table tennis paddles and 3 table tennis balls.

The applicable subheading for the 3-in-1 Game Table will be 9504.90.9080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Articles for arcade, table or parlor games, including pinball machines, bagatelle, billiards and special tables for casino games…parts and accessories thereof: Other: Other: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
