RE: The tariff classification of a men’s knit pullover from Cambodia.
Dear Mr. Nagel and Ms. Carothers:
In your letter dated November 3, 2008, you requested a tariff classification ruling. As requested, your sample will be returned.
Style D8260 is a men’s pullover garment constructed from 60% cotton, 40% polyester, finely knit, jersey fabric that measures 28 stitches per two centimeters counted in the horizontal direction. Style D8260 has a rib knit crew neckline; short, hemmed sleeves; contrasting color side panels of 100% polyester, finely knit mesh fabric; a reflective heat seal logo on the left chest; and a straight, hemmed bottom.
The applicable subheading for Style D8260 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The duty rate is 16.5% ad valorem.

Style D8260 falls within textile category designation 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
