RE: The tariff classification of a woman’s bralette from China.
Dear Ms. Stanczak:
In your letter dated October 6, 2008, you requested a classification ruling. The sample submitted will be returned.
The submitted sample, style 3538, is referred to as a “Bra Shape Brizzer” and is a bralette constructed of 92% nylon and 8% spandex knitted fabric. The garment features an elasticized edging that borders the top of the garment, a covered elasticized bottom band measuring approximately one inch wide, side seams, adjustable elasticized clear shoulder straps and a lined front panel.
The applicable subheading for style 3538 will be 6212.10.9020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for brassieres, girdles, corsets, braces, suspenders, garters, and similar articles and parts thereof, whether or not knitted or crocheted: brassieres: other: other, of man-made fibers. The duty rate will be 16.9 percent ad valorem.

Style 3538 falls within textile category 649. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
