RE: The tariff classification of yarns from Turkey and Italy

Dear Ms. Morrison:

In your undated letter received in our office on Oct. 10, 2008, on behalf of Orchard Yarn of Carlstadt, New Jersey, you requested a tariff classification ruling. The samples that you submitted are being returned.

You submitted three hanks of yarn. Each weighs 100 grams or less. By virtue of Section XI, Note 4(A)(b), Harmonized Tariff Schedule of the United States (HTSUS), each is considered put up for retail sale. In addition, all are carded and combed.

The first yarn is described as 100% organic wool. You state that the fiber diameter exceeds 19.5 microns. The second yarn is 100% cashmere; Note 1(b) to Chapter 51, HTSUS, lists cashmere as a fine animal hair for tariff purposes.

The applicable subheading for the wool yarn and the cashmere yarn will be 5109.10.9000, HTSUS, which provides for yarn of wool or fine animal hair, put up for retail sale: Containing 85% or more by weight of wool or fine animal hair …: Other:…Other:…Other. The rate of duty will be 6% ad valorem.

The third yarn is a blend of 70% mohair (Angora goat) and 30% silk. The applicable subheading for the mohair/silk yarn will be 5109.90.9000, HTSUS, which provides for yarn of wool or fine animal hair, put up for retail sale:…Other:…Other:…Other: . . .Other. The rate of duty will be 6% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
