RE: The tariff classification of PVC film from the United Kingdom
Dear Mr. Vick:
In your letter dated September 25, 2008, on behalf of Amtico International Corporation, you requested a tariff classification ruling.
The two sample sheets of film provided with your request are identified as decorative printed polyvinyl chloride (PVC) film. After importation the PVC film will be used in the construction of laminated flooring. The decorative printed film is stacked with other layers of plastics and laminated under heat and pressure to form vinyl flooring. The finished effect gives the product the look of natural wood or stone. You have stated that the plasticizer content in the imported PVC film will be between 5 percent and 7 percent.
The applicable subheading for the PVC film, when the formulation includes 6 percent or more by weight of plasticizers, will be 3920.43.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other plates, sheets, film, foil and strip, of plastics, noncellular and not reinforced, laminated, supported or similarly combined with other materials: of polymers of vinyl chloride: containing by weight not less than 6 percent of plasticizers: other. The rate of duty will be 4.2 percent ad valorem.
The applicable subheading for the PVC film, when the formulation includes less than 6 percent by weight of plasticizers, will be 3920.49.0000, HTSUS, which provides for other plates, sheets, film, foil and strip, of plastics, noncellular and not reinforced, laminated, supported or similarly combined with other materials: of polymers of vinyl chloride: other. The rate of duty will be 5.8 percent ad valorem.
