RE: The tariff classification of cigar bands from Austria

Dear Ms. Fritsche:

In your letter dated September 4, 2008, you requested a tariff classification ruling.

The merchandise under consideration is several styles of cigar bands. Each cigar band comprises a decorative, base metal emblem on a leather strap that closes with a magnetic clasp. Each comes in a fitted, calfskin case. Its only purpose is to ornament the cigar while unlit; it is removed from the cigar when smoked. Models number 1, 3 and 4 will be imported either with or without engravings. Model Sport can incorporate an emblem signifying any type of sport (the picture submitted includes an emblem designed in the shape of a soccer ball).

The applicable subheading for the cigar bands with base metal emblems will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bells, gongs and the like, nonelectric, of base metal…statuettes and other ornaments, and parts thereof, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
