RE: The tariff classification of Deluxe Wrist Brace and Deluxe Wrist Stabilizer from China.
Dear Ms. Kelly-Kobayashi:
In your letter dated August 20, 2008, for Becton, Dickinson and Company, you requested a tariff classification ruling. Two samples were provided.
You state:
“The Ace ‘Deluxe Wrist Brace’ is composed of rigid plastic with a removable inner nylon padding. The brace wraps around the thumb and hand and closes with two strap hooks and has an opening for the thumb. Enclosed is a sample of product number 200277 in size medium for the left hand. The exact same article is available in size small for the left hand (200276), size medium for the right hand (200279), and size small for the right hand (200278).”
“The Ace ‘Deluxe Wrist Stabilizer’ is composed of textile material and contains a rigid plastic sprint which is about seven inches long and two inches wide. The wrist stabilizer has three closures secured by Velcro and an opening for the thumb and fingers. Enclosed is a sample of product 201814 for the left hand in size L/XL. The wrist stabilizer is also available for the right hand in L/XL (201816), S/M for the left hand (201813), and S/M for the right hand (201815).”
From the samples and their packaging, we agree that both will be used ‘to immobilize the wrist in order to promote healing.” We note that the packaging for the 200277 states that it “immobilizes wrist” and that the 201814 states that it is “comfortable for day or night use” and that “stabilizing the wrist while resting and sleeping is a common part of physician recommended therapy.”
We agree that applicable subheading for these wrist braces/stabilizers will be 9021.10.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other" Orthopedic or fracture appliances, and parts and accessories thereof. The general rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
