RE: The tariff classification of a woman’s dress from China
Dear Mr. Gazitua:
In your letter dated August 5, 2008, you requested a classification ruling. Your sample will be returned as requested.
Submitted sample, style #98FQ0059, is a woman’s dress composed of two woven fabrics. The upper portion, which extends from the shoulders to the bust line and includes the sleeves, is constructed from 100% silk. The bottom portion is constructed from 98% wool and 2% lycra. The pullover dress features a scoop neckline, short sleeves, a side seam zipper, a partial lining, self-fabric belt loops, a seven inch rear vent and a hemmed bottom.
The applicable subheading for the style 98FQ0059 will be 6204.41.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of wool or fine animal hair: other: women’s. The duty rate will be 13.6 percent ad valorem.

Style 98FQ0059 falls within textile category 436. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
