RE: The tariff classification of protective rain apparel from Canada.
Dear Ms. Butcher:
In your letter dated July 17, 2008, you requested a tariff classification ruling. The samples which you submitted are being returned as requested.
The submitted samples are a waterproof jacket, pants and hood made of a blend of Nomex and Kevlar nonwoven fabric coated on the outer surface with a compact polyvinylchloride (PVC) plastic material, which is a fabric of heading 5603.
Style J162 310DH is a hip length jacket with a detachable hood, stand-up collar, reflective tape, and a full front zipper closure with a flap and a hook and loop strip closure. The bottom features a drawcord closure.
Style P162 041is a bib and brace overall with a full front bib extending more than six inches above the natural waistline and over the shoulder straps.
Style H162 502 is a hood with snaps at the back and a drawcord.
The applicable subheading for the jacket Style J162 310DH will be 6210.10.9040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Garments made up of fabrics of heading 5602, 5603, 5903, 5906 and 5907: Of fabrics of heading 5602 or 5603: Other: Other: Other, Other”. The general duty rate will be 16 percent ad valorem.
The applicable subheading for the bib and brace overalls, Style P162 041 will be 6210.10.9010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Garments made up of fabrics of heading 5602, 5603, 5903, 5906 and 5907: Of fabrics of heading 5602 or 5603: Other: Other: Other, overalls and coveralls.” The general duty rate will be 16 percent ad valorem.
The applicable subheading for hood, Style H162 502 will be 6505.90.8090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric…Other: Of man-made fibers: Other: Not in part of braid, Other: Other: Other." The general rate of duty will be 18.7 cents /kg + 6.8 percent ad valorem.
