RE: The tariff classification of kitchen towels from China
Dear Ms. Parmann:
In your letter dated June 30, 2008 you requested a classification ruling.
The submitted samples, identified as SKU-2008-10PKCST, are kitchen towels. All of the towels are made from 100 percent cotton flat woven jacquard fabric. They measure 17 x 28 inches. All of the edges are hemmed.
You have indicated that you will import these towels banded together with several cotton terry kitchen towels. In order to provide a classification of the banded set, we need to examine a sample of the 10-pack in the condition it would be imported.
The applicable subheading for the submitted flat woven jacquard kitchen towels will be 6302.91.0035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of cotton… other: towels: jacquard figured. The duty rate will be 9.2 percent ad valorem.

The kitchen towel falls within textile category designation 363. Textile category designation 363 from China falls within the recently announced quantitative restrictions between the United States and China, commonly referred to as China Safeguards or Safeguard Quotas. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the "Textile Status Report for Absolute Quotas" available at our web site at www.cbp.gov. In addition, you will find current information on textile import quotas, textile safeguard actions and related issues at the web site of the Office of Textiles and Apparel, at otexa.ita.doc.gov.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
