RE: The tariff classification of a shawl from China.

Dear Mr. Fiske:

In your letter dated May 20, 2008, on behalf of Downlite, you requested a classification ruling. The sample will be returned to you.

The submitted sample Style YSC Caring Wrap is made of knit 100% polyester fabric with polyester fill and a satin piping trim. The item is used around the shoulders while resting or reading. It is imported in a clear vinyl case, which is considered normal packing. The item is not a bed jacket of heading 6108 as it does not have enough definition, and has no sleeves or closure.

The applicable subheading for the Caring Wrap will be 6117.10.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessories, knitted or crocheted;…Shawls, scarves, mufflers, mantillas, veils and the like: Of man-made, Other." The duty rate will be 11.3% ad valorem. The textile category designation is 659.
