RE: The tariff classification of a scarf from China.

Dear Ms. Lee:

In your letter dated May 16, 2008, you requested a classification ruling. As requested, the sample will be returned.

The submitted sample is a Style# 98620 Woman’s Scarf constructed of knit 100% wool fabric that is entirely covered in sequins. The scarf has a woven 100% silk lining and measures approximately 3 inches by 60 inches.

The applicable subheading for the Style# 98620 Woman’s Scarf will be 6117.10.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other made up clothing or accessories, knitted or crocheted; knitted or crocheted parts of garments or clothing accessories: Shawls, scarves, mufflers, mantillas, veils and the like: Of wool or fine animal hair.” The rate of duty will be 9.6 percent ad valorem.

The Style# 98620 Woman’s Scarf falls within textile category 459. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
