RE: The tariff classification of a woman’s cardigan from China.
Dear Ms. Mehnert:
This letter replaces the ruling letter we sent to you under file number N025417. The purpose of this replacement letter is to correct the classification of style P380739CB, which was inadvertently classified as a woven garment. A corrected letter follows.
The submitted sample, style P380739CB, is a woman’s cardigan that is constructed from 100% silk knit fabric with 100% woven silk overlays on the front panels. The outer surface of the knit fabric measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The garment features a crew neckline, ¾ length sleeves with ribbed cuffs, a full front opening with a 6 button ribbed placket, and a ribbed bottom. The essential character is given by the knit fabric of the garment.
The applicable subheading for the cardigan will be 6110.90.1060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters…and similar articles, knitted: of other textile materials: containing 70 percent or more by weight of silk or silk waste: other: women’s. The duty rate will be 0.9% ad valorem.

The cardigan falls within textile category 739. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
