RE: The tariff classification of headbands from China.

Dear Ms. Collins:

In your letter dated May 8, 2008, you requested a tariff classification ruling.

You have submitted two samples of headbands, which will be returned to you as requested. The first is an enamel chain headband, Style Number YTRUA087. It is made predominantly of base metal including the “Juicy” logo. The second, Style Number YTRUA079, is a leather headband, held together by a textile ribbon.

The applicable subheading for the enamel chain headband will be 9615.19.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Combs, hair-slides and the like: Other: Other”. The rate of duty will be 11 percent ad valorem.

The applicable subheading for the leather headband will be 4203.40.6000, HTSUS, which provides for “Articles of apparel and clothing accessories, of leather or composition leather: Other clothing accessories: Other”. The rate of duty will be free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
