RE: The tariff classification of porous-tipped highlighters from China
Dear Mr. Rolla:
In your letter dated May 8, 2008 you requested a tariff classification ruling.
The submitted illustration depicts an item identified as a Britewriter 30ct Highlighter Combo Pack. This item consists of 30 porous-tipped markers in three different styles. Included in this item are 12 desk style highlighters, each with a wide barrel, 12 pen style highlighters, each with a barrel that has the width of a pen, and 6 mini style highlighters, each with a short length barrel.
The 12 desk style highlighters and the 12 pen style highlighters each consist of 4 highlighters of yellow color and 2 each of the following 4 colors: orange, pink, green and blue. The 6 mini highlighters consist of 2 highlighters of yellow color and 1 each of the following 4 colors: orange, pink, green and blue.
All of the highlighters in this item feature porous felt-like tips, known as nibs, made of polyethylene. The barrel of each highlighter is made of polypropylene (PP) plastic material and each highlighter has a grip made of thermal plastic rubber (TPR).
The applicable subheading for the Britewriter 30ct Highlighter Combo Pack will be 9608.20.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for felt tipped and other porous-tipped pens and markers. The rate of duty will be 4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
