RE: The tariff classification of men’s knit garments from China.
Dear Ms. Klarman:
In your letter dated April 25, 2008, you requested a tariff classification ruling on behalf of Ecko Complex LLC. As requested, your samples will be returned.
Style M08-03917 is a men’s pullover garment constructed from 100% cotton, finely knit, printed jersey fabric that measures 26 stitches per two centimeters counted in the horizontal direction. Style M08-03917 is sleeveless and has a rib knit crew neckline; rib knit trim at the armholes; large appliqués on the left chest; a half-moon sweat patch; a small appliqué at the rear neckline; contrasting solid color side panels; and a straight, hemmed bottom.
Style M08-03965 is a men’s hooded vest constructed from 100% cotton, finely knit, printed French terry fabric that measures 20 stitches per two centimeters counted in the horizontal direction. The vest is sleeveless and has oversized armholes; a self-fabric hood with a small appliqué and a drawstring; a full front opening with a zippered closure; large appliqués on the left chest; pouch pockets below the waist; and a rib knit bottom.
The applicable subheading for Style M08-03917 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The duty rate is 16.5% ad valorem.
The applicable subheading for Style M08-03965 will be 6110.20.2030, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: vests, other than sweater vests: men’s or boys’. The rate of duty is 16.5% ad valorem.

Style M08-03917 falls within textile category designation 338. Style M08-03965 falls within textile category designation 359. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
