RE: The tariff classification of plastic overlays from Canada
Dear Mr. Moyles,
In your letter dated April 23, 2008, you requested a tariff classification ruling.
The items under consideration are two (2) Lexan overlays used in motor vehicles to visually indicate a function or malfunction.
The first overlay, model S53-1109 is, as stated in your Ruling Request, used only in trucks. The overlay consists of two parts. The first part measures approximately 3 ¼ inches in length and 1 ½ inches in height. It contains seven (7) lexicons which appear when illuminated from behind. The second part measures 1 ½ inches in length and 1 ¼ inches at its highest point. It contains the words, “Right Side”.
The second overlay, model U53-1008 is, as stated in your Ruling Request, used only in trucks. The overlay consists of matte velvet polycarbonate that has been silk screened and stenciled with black and white ink. The overlay is designed to fit onto a heating/air-conditioning control instrumentation panel found in the cab of a truck. The overlay measures approximately 4 ¾ inches in length and 2 ½ inches in height. The wording is in both English and Spanish.
The applicable classification subheading for the overlay models S53-1109 and U53-1008 will be 4911.99.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other (non-enumerated) printed matter. The general rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
