RE: The tariff classification of a girl’s leotard from China.
Dear Ms. Stanczak:
In your letter dated February 25, 2008, you requested a classification ruling.
The submitted sample, Style 4007C, Cap Sleeve Leo, is a girl’s leotard made of knit fabric that is 90% nylon, 10% spandex. The garment has short puff sleeves, a vee neck opening at the front that is cut on the bias and a vee neck drop at the back neckline.
The applicable subheading for the Style 4007C, Cap Sleeve Leo, will be 6114.30.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other garments, knitted or crocheted: Of man-made fibers: Bodysuits and bodyshirts, Of fabric containing by weight 5 percent or more of elastomeric yarn or rubber thread." The rate of duty will be 32% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
