RE: The tariff classification of Ibuprofen Tablets, Propranolol Tablets, Allopurinol Tablets and Atenolol Tablets from India
Dear Mr. Moynihan:
In your letter dated January 31, 2007, you requested a tariff classification ruling.
The first product, Ibuprofen Tablets, is a medicinal preparation, in tablet form, containing Ibuprofen, a nonsteroidal anti-inflammatory drug (NSAID), as the active ingredient.
The second product, Propranolol Tablets, is a medicinal preparation, in tablet form, containing Propranolol, a drug indicated for the management of hypertension and angina pectoris (among other things), as the active ingredient.
The third product, Allopurinol Tablets, is a medicinal preparation, in tablet form, containing Allopurinol, a drug indicated for the treatment of gout, as the active ingredient.
The fourth product, Atenolol Tablets, is a medicinal preparation, in tablet form, containing Atenolol, a drug indicated for the treatment of hypertension and angina pectoris, as the active ingredient.
The applicable subheading for Ibuprofen Tablets will be 3004.90.9128, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the central nervous system: Analgesics, antipyretics and nonhormonal anti-inflammatory agents: Other.” The rate of duty will be free..
The applicable subheading for Propranolol Tablets and Atenolol Tablets will be 3004.90.9120, HTSUS, which provides for “Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Cardiovascular medicaments. The rate of duty will be free.
The applicable subheading for Allopurinol Tablets will be 3004.90.9190, HTSUS, which provides for “Medicaments … consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses … or in forms or packings for retail sale: Other: Other: Other: Other.” The rate of duty will be free.
