RE: The tariff classification of a banner/flag from China
Dear Mr. Brownworth:
In your letter dated October 20, 2006, you requested a tariff classification ruling on behalf of your client, Wood ‘N’ Kites.
The submitted sample is a banner/flag that you state is constructed of 100% nylon textile fabric. It measures approximately 16’3” x 42” and features a 3” fold for the insertion of a pole, creating what would appear to be a front and a back.
The applicable subheading for the banner/flag will be 6307.90.8500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up articles…Other: Wall banners, of man made fibers. The rate of duty will be 5.8% ad valorem.
You suggest that the correct classification is in subheading 6307.90.9889, which provides for other made up articles. . .Other ;Other. However, the subheading for wall banners is more specific.
