RE: The tariff classification of a CD storage box from China

Dear Ms. Barclay:

In your letter dated August 7, 2006, you requested a tariff classification ruling.

The sample submitted with your request is a lidded storage box sized to hold compact disks. The sample is labeled LEED’S HCDC-1, C-16778L, 8150-08BK. You indicate that it is used in the home for organization of CDs and DVDs. The box is made of paperboard covered with cellular polyvinyl chloride (PVC) plastic sheeting backed with nonwoven textile fabric for mere reinforcement. This construction is considered to be of plastics for tariff classification purposes. The box includes CD sleeves and organizer cards. The sleeves and cards are packaged for retail sale with the storage box in a cardboard box.

The applicable subheading for the lidded storage box with the included CD sleeves and organizer cards will be 3924.90.5500, HTSUS, which provides for tableware, kitchenware, other household articles and toilet articles, of plastics: other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
