RE: The tariff classification of a girls’ pullover from China
Dear Mr. LoPresti:
In your letter dated May 12, 2006, written on behalf of Cherry Stix Ltd., you requested a classification ruling.
Submitted style 3002, manufactured from finely knitted fabric of 92% acrylic/5% nylon/3% spandex, is a long-sleeved, v-necked, sequined garment.
As you have requested, the sample garment and its accompanying component parts are being returned.
Although you suggested classification under HTS 6110.30.3055, that tariff number does not exist. The applicable subheading for this style will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for …pullovers…knitted…of man-made fibers, other, other, other, other, other, …girls’, other. The duty rate will be 32 per cent ad valorem.

The pullover falls within textile category designation 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
