RE: The tariff classification of Bisphenol S (CAS 80-09-1), imported in bulk form, from China

Dear Mr. Fairchild:

In your letter dated February 8, 2006, you requested a tariff classification ruling for Bisphenol S. In addition, you requested information regarding antidumping duties.

The subject product, Bisphenol S, chemically known as Phenol, 4,4'-sulfonylbis-, is an aromatic organo-sulfur compound. The product is indicated for use as a raw material in the manufacture of epoxy, polycarbonate, polyether sulfone and thermal material. It is also indicated for use as an intermediate chemical for dyes.

The applicable subheading will be 2930.90.2900, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other aromatic organo-sulfur compounds. The rate of duty will be 6.5 percent ad valorem. Pursuant to General Note 14 to the Harmonized Tariff Schedule of the United States, this product will be free of duty.

You have asked whether this product is subject to antidumping duties. Written decisions regarding the scope of AD/CVD orders are issued by the Import Administration in the Department of Commerce and are separate from tariff classification and origin rulings issued by Customs.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
