RE: The tariff classification of a man’s shirt from China.
Dear Ms. Stubblefield:
In your letter dated March 21, 2005, you requested a tariff classification ruling. As requested, your sample will be returned.
Style P2101 is a man’s shirt constructed from 65 percent polyester, 35 percent cotton, solid color, woven twill fabric. Style P2101 features a button-down collar; a left over right full front opening with seven button closures; long sleeves with buttoned cuffs; a pocket on the left chest; and a curved, hemmed bottom. The shirt will be imported in men’s sizes XS-4XL. The same garment will be imported as Style P2101Y in boys’ (youth) sizes YXS-YXL.
The applicable subheading for Style P2101 will be 6205.30.2070 which provides for men’s or boys’ shirts, of man-made fibers, other: other: other: men’s. The duty rate is 29.1cents per kg. plus 25.9% percent ad valorem.
The applicable subheading for Style P2101Y will be 6205.30.2080 which provides for men’s or boys’ shirts, of man-made fibers, other: other: other: boys’: other. The duty rate is 29.1 cent per kg. plus 25.9% ad valorem.
Styles P2101 and P2101Y fall within textile category designation 640. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
