RE: The tariff classification of a nutcracker from China
Dear Ms. Marcoux:
In your letter dated March 14, 2005, you requested a tariff classification ruling.
The merchandise is a nutcracker made of cast iron (item number 29670). The nutcracker is shaped like a walnut. While resting on a flat surface, a hinge enables it to open and shut in order to crack nuts inside. The nutcracker measures approximately 4.5 inches long by 3 inches wide by 2.5 inches high. It weighs less than 10 kg.
The applicable subheading for the nutcracker will be 8210.00.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for hand-operated mechanical appliances, weighing 10 kg. or less, used in the preparation, conditioning or serving of food and drink, and base metal parts thereof. The rate of duty will be 3.7 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
