RE: The tariff classification of the Christmas Snow Globe from China
Dear Mr. Hoffacker:
In your letter dated February 3, 2005, on behalf of The Pfaltzgraff Company, you requested a tariff classification ruling for the Christmas Snow Globe from China. A picture of the Christmas Snow Globe was submitted with the ruling request.
Item number 24791400 for which you are requesting a ruling is identified as the Christmas Snow Globe. The submitted picture shows that inside the snow globe there are three-dimensional trees and a train. Santa Claus is in a seated position inside the train. The picture also shows that the base of the Christmas Snow Globe is decorated with holly and berries. You indicate that the base and inside scene are made of ceramic and the globe is made of glass. The Christmas Snow Globe has a wind up music mechanism on the bottom.
The National Import Specialist for festive articles has stated that the Christmas Snow Globe is not classifiable in Chapter 95 as a festive article. The Christmas Snow Globe is classifiable in Chapter 92 as a music box.
The applicable subheading for the Christmas Snow Globe will be 9208.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for music boxes. The rate of duty will be 3.2 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
