RE: The tariff classification of a men’s knit pullover garment from Malaysia.
Dear Ms. Desjardins:
In your letter dated December 2, 2004, you requested a tariff classification ruling on behalf of Oshkosh B’Gosh Incorporated.
Style W2155C is a men’s pullover garment constructed from 100 percent cotton, finely knit pique fabric that measures 18 stitches per two centimeters counted in the horizontal direction. The garment has a rib knit spread collar; a partial front opening with three button closures; short sleeves with rib knit cuffs; an embroidered logo on the left sleeve; a sweat patch at the rear neckline; and a hemmed bottom with side slits and a tail.
The applicable subheading for Style W2155C will be 6110.20.2065, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men's or boys'. The rate of duty is 16.5 percent ad valorem.
Style W2155C falls within textile category designation 338. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
