RE: The tariff classification of the Swiffer™ Duster from Japan.

Dear Ms. Bade:

In your letter dated August 18, 2004, on behalf of The Procter & Gamble Company, you requested a tariff classification ruling.

The item under consideration is The Swiffer™ Duster. The Swiffer™ Duster is a unique cleaning tool designed to clean both large areas as well as hard-to-reach locations with its fluffy, feather-like fiber duster. It is available in two different styles: one with a small, plastic handle, and the other with an extendable, pivoting plastic handle which reaches 3 feet and can be locked into 4 different positions. Both styles are imported in a disassembled state and packaged with disposable dusters. The dusters are made of spunbound and thermal bond nonwoven, airlaid polyethylene/polyethylene terephthalate (PE/PET) tow fibers. The dusters have two long, narrow slots on top which have been heat-sealed to create a seam in which the plastic prongs are inserted when attaching the dusters to the handles. Both the short handle Swiffer™ Duster and the extendable handle Swiffer™ Duster are packaged at the time of import with several disposable dusters. You have attached copies of the marketing materials for both products. You have also submitted samples of both styles of the Swiffer™ Dusters.

The applicable subheading for the Swiffer™ Duster will be 9603.90.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for “Brooms, brushes… mops and feather dusters… Other… Other.” The rate of duty will be 2.8% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
