RE: The tariff classification of a Flower Bouquet in a Glass Vase from China.

Dear Ms. Santos:

In your letter dated April 14, 2004, you requested a classification ruling.

The submitted sample is identified as item number 270456, a “Flower Bouquet in a Glass Vase”. This item is approximately 8” high and will be available in two styles; mixed Sunflowers or Mum Bouquets. The man-made fiber woven flowers are permanently affixed inside the glass vase in a clear acrylic base that appears as water. Glass pebbles are dispersed throughout the clear acrylic. The artificial flowers and pebbles look as though they are in water. The artificial flowers impart the essential character to this product.

The sample is returned as you requested. The applicable subheading for the artificial flowers in a glass vase will be 6702.90.3500, Harmonized Tariff Schedule of the United States (HTS), which provides for artificial flowers, foliage and fruit and parts thereof; articles made of artificial flowers, foliage or fruit: Other: of man-made fibers. The rate of duty will be 9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
