RE: The tariff classification of a tote bag from China
Dear Ms. Kwok:
In your letter dated November 18th, 2003 you requested a tariff classification ruling for a tote bag.
The sample submitted, identified as Style #C-77036-1, is a tote bag that is constructed of 100 percent woven cotton textile fabric. Measuring approximately 18”W x 13 ¾”H x 7 ¾”D, the open bag features an interior pocket and webbed carrying straps.
The applicable subheading for the tote bag will be 4202.92.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The rate of duty will be 6.4 percent ad valorem.
HTS 4202.92.1500 falls within textile category designation 369. Based upon international textile trade agreements, products of China are not currently subject to quota and the requirement of a visa.
You have asked whether this product is subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
