RE: The tariff classification of a climbing harness from China.
Dear Mr. Gellert:
In your letter dated February 23, 2001, you requested a tariff classification ruling.
You are requesting the tariff classification on a climbing harness, BD650603, Mentor2 Harness. The submitted sample is part of a line of climbing harnesses intended for rock and ice climbing. There are 13 styles in all, and style BD650603 is representative of the other 12 styles. The Mentor2 climbing harness, exclusive of accessories and trim, is constructed primarily from 5/16( closed-cell foam, 500D Cordura( material, injection-molded gear loops, and nylon webbing. The climbing harness will be classified in Chapter 95 of the HTSUSA as equipment for outdoor games or general physical exercise. The sample will be returned, as requested.
The applicable subheading for the climbing harness for rock and ice climbing will be 9506.99.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Articles and equipment for general physical exercise, gymnastics, athletics, other sports...or outdoor games...parts and accessories thereof: Other...Other.” The rate of duty will be 4 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
