RE: The tariff classification of Thermowells from Singapore and India

Dear Mr. Madhavan:

In your letter dated September 26, 1997, you requested a tariff classification ruling.

Thermowells are designed to shield and protect temperature sensors (temperature probe, RTD-resistance temperature detector, thermocouple and bi-metal thermometer) against corrosion, mechanical damage and other variables while permitting easy installation of sensor replacements. They will be used in machines which measure temperature (e.g., boilers, heat exchangers, heaters, and condensers).

The applicable subheading for the thermowells will be 9025.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for thermometers, parts and accessories. The duty rate will be 3.1 percent ad valorem.

Articles which are classifiable under subheading 9025.90.0000, HTS, which are products of India are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

We can not determine the country of origin of your goods with the information you furnished. For us to do so, you will need to furnish detailed information describing what manufacturing processes are done in each country including the costs of materials and labor added in each country. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
