RE: The tariff classification of plaited polypropylene plastic sheets from India.

Dear Mr. Toprani:

In your letter dated January 30, 1997, you requested a tariff classification ruling.

Samples were submitted and will be retained for reference. They are sheets made up of thin, flexible strips of polypropylene plastic that have been woven together. You state that the width of the individual strips is 5.2 mm. The sample sheets also appear to have been continuously coated on one side with a thin plastic film.

The sheets, which are supplied in both clear and white versions, will be imported in the size of 40" x 55". They will serve as "bale wrapping covers" for used clothing and rags to be exported from the United States.

The applicable subheading for the above-described woven polypropylene sheets will be 4602.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other (non-enumerated) articles of plaiting materials. The rate of duty will be 4.2%.

Articles classifiable under subheading 4602.90.0000, HTS, which are products of India are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
