RE: The tariff classification of two women's garments from Chins.
Dear Mr. Simon:
In your letter dated July 15, 1993, on behalf of Accessory
Network, you requested a tariff classification ruling.
In your letter you indicate four garments to be classified.
However, you submitted only three garments. Upon further
conversation, you requested a binding ruling for only two of these
garments; style numbers K43112 and K4310077. Style number K43112
is a woman's vest constructed from crochet and woven fabric. The
front panels are constructed entirely from 65% ramie, 35% cotton,
fine yarns crocheted into a decorative openwork pattern. The back
panel is constructed from 100% cotton, woven sheeting. The vest
features a V-neckline; oversized armholes; and a full frontal
opening with a tie closure. The bottom of the garment (front &
back) is also finished with the crochet fabric.
Style number K4310077 is a woman's vest. The front two panels
are constructed from 55% ramie, 45% polyester, brocade woven
fabric. The back panel is constructed from 65% polyester, 35%
cotton, woven fabric. The garment features a V-neckline; oversized
armholes; a full frontal opening with a four button closure; two
simulated flap pockets at the waist; and an adjustable tie on the
back panel at the bottom.
Your samples are being returned as requested.
The essential character of each vest is imparted by its front
panels, applying the General Rules of Interpretation, GRI 3(b),
Harmonized Tariff Schedule of the United States (HTS).
The applicable subheading for style K43112 will be 6110.90.0066,
Harmonized Tariff Schedule of the United States (HTS), which
provides for women's sweaters....vests and similar articles,
crocheted: of other textile materials: vests, other than sweater
vests: other: other. The duty rate will be 6% ad valorem.

The applicable HTS subheading for style K4310077 will be
6211.49.0080, which provides for women's tracksuits....other
garments: of textile materials: other: vests. The duty rate will
be 7.8% ad valorem.
Both garments fall within textile Category designation 859.
Based upon international textile trade agreements, products of
China are subject to quota restraints and visa requirements.
The designated textile and apparel category may be subdivided
into parts. If so, visa and quota requirements applicable to the
subject merchandise may be affected. Since part categories are the
result of international bilateral agreements which are subject to
frequent renegotiations and changes, to obtain the most current
information available, we suggest that you check, close to the time
of shipment, the Status Report On Current import Quotas (Restraint
an internal issuance of the U.S. customs Service, which is
available for inspection at your local Customs Office.
This ruling is being issued under the provisions of Section 177
of the Customs Regulations (19 C.F.R. 177).
A copy of this ruling letter should be attached to the entry
documents filed at the time this merchandise is imported. If the
documents have been filed without a copy, this ruling should be
brought to the attention of the Customs officer handling the
transaction.
