Dear Mr. Anderson:
This classification decision under the Harmonized Tariff
Schedule of the United States (HTS) is being issued in accordance
with the provisions of Section 177 of the Customs Regulations (19
C.F.R. 177).

DESCRIPTION OF
MERCHANDISE : The submitted sample consists of a molded plastic
game piece shaped like a blimp, measuring
approximately five inches in length. The players
blow into a hole on the unit which activates two
spinners. The first spinner selects a letter of
the alphabet; the other spinner selects one of
five categories. The players then must name
something beginning with the letter selected by
the first spinner in the category selected by the
second spinner. The item is packaged with a
written set of rules. The unit is considered a
game machine for tariff classification purposes.
HTS PROVISION : Games machines, other than coin or token operated.
HTS SUBHEADING : 9504.90.4000
RATE OF DUTY : 3.9 percent ad valorem.
A copy of this ruling letter should be attached to the entry documents
filed at the time this merchandise is imported. If the documents have been
filed without a copy, this ruling should be brought to the attention of the
Customs officer handling the transaction.
