RE: The tariff classification of a plaited PVC strip Easter basket from China

Dear Ms. Aldinger:

In your letter dated October 15, 1995, which was received in our office on November 6, 1995, you requested a tariff classification ruling.

The ruling was requested on your item number 94690, a "Poly Easter Basket." A sample of a plastic pastel colored oval shaped basket with a handle was submitted. It is made primarily from interwoven strips measuring approximately 12 mm wide and consisting of eight connected PVC tubes. A few strips running across the side measure approximately 6 mm wide and consist of three connected PVC tubes. The supporting strips on the bottom, vertical sides, rim and handle of the basket are reinforced with wire.

The applicable subheading for the interwoven PVC strip basket will be 4602.90.0000, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for basketwork, wickerwork and other articles, made directly to shape from plaiting materials or made up from articles of heading 4601; other (than of vegetable materials). The rate of duty will be 4.9 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
