RE: The tariff classification of electric light sets from China.
Dear Mr. Natale:
In your letter dated June 19, 2001, on behalf of YMT International, Inc., you requested a tariff classification ruling.
The samples submitted consist of the following electric light sets:
icicle light sets, item numbers 74030, 74064 and 73854, that feature white-colored electrical wire harnesses containing strands of different sizes. These strands, possessing 600, 300 and 150 sockets with miniature clear light bulbs, respectively, are designed to impart an icicle-like effect for decorating windows, eaves, decks, porches and patios. There is also a light set, item number 74808, that is similarly constructed as the above-described light sets but contains 300 sockets with miniature blue light bulbs.
two curtain light sets, item number 73956, that feature two white-colored electrical wire harnesses containing strands of different sizes to impart a curtain-like effect. The strands of both sets possess 100 sockets with miniature clear light bulbs that are designed to decorate two standard windows.
a net-shaped green-colored light set, item number 73995, that measures approximately 72 inches by 48 inches and possesses 150 sockets with miniature clear light bulbs for steady burning or flashing. It is stated to be used for decorating trees, bushes, hedges, balconies and fences.
The applicable subheading for these electric light sets will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric lamps and lighting fittings of other than base metal. The rate of duty will be 3.9 percent ad valorem.
This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
