RE: The tariff classification of Corticotropin (CAS-9002-60-2) in bulk form, from Spain

Dear Forstenzer:

In your letter dated December 6, 2013, you requested a tariff classification ruling.

The subject product, Corticotropin, also known as adrenocorticotropic hormone (ACTH), is a polypeptide tropic hormone that is produced and secreted by the anterior pituitary gland. It stimulates the adrenal cortex and its production of corticosteroids. In your letter, you stated that it will be used in the treatment of MS and infantile spasms in infants and children under 2 years of age.

The applicable subheading for the Corticotropin in bulk form will be 2937.19.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Hormones, prostaglandins, thromboxanes and leukotrienes, natural or reproduced by synthesis; derivatives and structural analogues thereof, including chain modified polypeptides, used primarily as hormones: Polypeptide hormones, protein hormones and glycoprotein hormones, their derivatives and structural analogues: Other.” The rate of duty will be free.
