RE: The tariff classification of a carriage bolt, double helical spring lock washer and a hex flange nut from China and Taiwan.

Dear Mr. Rose:

In your letter dated May 18, 2011, you requested a tariff classification ruling.

You have submitted literature and drawings describing the following steel items: Square head machine bolt measuring 5/8” x 2” – part number 30013 Fully threaded round head square neck carriage bolt measuring ½” x 2” – part number 30060 1 3/8” long T head nail – part number 30078 3/8” hex flange nut – part number 30451 ½” double coil helical spring lock washer – part number 30282 You have stated that these items are to be used for assembly of equipment racks utilized in the construction of over-head power lines.

The applicable subheading for the carriage bolt will be 7318.15.2055, Harmonized Tariff Schedule of the United States (HTSUS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: bolts and bolts and their nuts or washers entered or exported in the same shipment: having shanks or threads with a diameter of 6 mm or more: other: with round heads: other. The duty rate will be free.

The applicable subheading for the hex flange nut will be 7318.16.0085, HTSUS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: threaded articles: nuts: other: other. The duty rate will be free.

The applicable subheading for the double coil helical spring lock washer will be 7318.21.0030, HTSUS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: non-threaded articles: spring washers and other lock washers: helical spring lock washers. The duty rate will be 5.8% ad valorem.

The helical spring lock washer in question may be subject to antidumping duties or countervailing duties. Written decisions regarding the scope of AD/CVD orders are issued by the Import Administration in the Department of Commerce and are separate from tariff classification and origin rulings issued by Customs and Border Protection. Your inquiry does not provide enough information for us to give a classification ruling on the square head machine bolt and the T head nail. Your request for a classification ruling should include samples of both items. In addition, submit the following information on the T nail: Is it made of round wire? Will the nail be imported in collated strips of plastic, paper or wire? Does it have a smooth shank? Is the nail coated (if so, with what) or galvanized? When this information is available, you may wish to consider resubmission of your request. We are returning any related exhibits. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
