RE: The tariff classification of an RF receiver module, item # 9166264 01, from Germany

Dear Mr. Hoch:

In your letter dated April 1, 2009, you requested a tariff classification ruling.

The merchandise subject to this ruling is an RF receiver module. The furnished sample is identified as item # 9166264 01. The RF receiver module is a populated printed circuit assembly. It receives and sends out electrical signals from a wireless remote, which are passed onto the main unit of a theft deterrent system as a serial digital signal, over electrical cable. The RF receiver, part of an OEM automotive remote keyless entry and theft deterrent system, is installed in the rear view mirror of the vehicle. The serial data from the RF module is interpreted by the main controller as to which button was pushed (such as lock, unlock, arm, panic) on the remote controller. The RF receiver module contains an LED indicator, which flashes when a signal is received, as well as when the theft deterrent system is armed. The LED is visible on the rear view mirror of the vehicle, and can be seen as the vehicle is approached from outside.

You suggested Harmonized Tariff Schedule of the United States (HTSUS) subheading 8526.92.0000, which provides for radio remote control apparatus.  However, the receiver module on its own performs the function of reception and transmission of RF signals.  Apparatus that transmits and/or receives is provided for in heading 8517.  As such, subheading 8526.92.0000 is inapplicable.

The applicable subheading for an RF receiver module, item # 9166264 01, will be 8517.62.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Machines for the reception, conversion and transmission or regeneration of voice, images or other data, including switching and routing apparatus: Other." The rate of duty will be Free.
