RE: The tariff classification of polyethylene flakes from China.

Dear Ms. Oliver:

In your letter dated May 16, 2008 you requested a tariff classification ruling. Your sample is being returned.

The product is described as Decorative Artificial Snow consisting of polyethylene materials compressed into flakes, cut into small pieces, and packaged for retail sale in clear plastic bags (3”L x 3W” x 8”H) tied with raffia.

The applicable subheading for the polyethylene flakes packaged for retail sale will be 3901.90.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Polymers of ethylene, in primary forms: Other: Other: Other. The rate of duty will be 6.5% ad valorem.
