RE: The tariff classification of two thermal carafes from China

Dear Mr. Campbell:

In your letter dated July 23, 1996, on behalf of your client, Progressive International Corp., you requested a tariff classification ruling regarding two thermal carafes. Representative samples were submitted with your ruling request and were sent to our Customs laboratory for analysis.

Item no. TVG-1000 and item no. TVC-1BK both have a plastic outer body and an inner glass liner. The laboratory has determined that these glass liners are doubled walled with a vacuum between the walls.

The applicable subheading for the two carafes will be 9617.00.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for vacuum flasks and other vacuum vessels, complete with cases; parts thereof other than glass inners: having a capacity not exceeding 1 liter. The rate of duty will be 8.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Jacob Bunine at 212-466-5796.

Sincerely,
