RE: The tariff classification of Autostem™ and Booster Cartridges from South Africa

Dear Mr. Saenz:

In your letter dated January 02, 2015, you requested a tariff classification ruling on behalf of Non-Detonating Solutions (Pty) Ltd.

The subject merchandise consists of a polymer cartridge (Autostem™) and Booster cartridge, both from South Africa. The Autostem™ cartridges consist of a polymer cartridge, with lengths varying from 84mm to 420mm. The Autostem™ cartridges contain between 20 grams to 100 grams of a granular mix content. The booster cartridge is only produced in 60g and 100g formats. The cartridges contain an electrical igniter. The granular mix is designed to deflagrate on initiation. The granular mix consists of a mix of smokeless powder and ammonium nitrate (ANA). The cartridges will be used to break rock and concrete in the construction, demolition and related industries.

The applicable subheading for the Autostem™ and Booster Cartridges will be 3602.00.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides which provides for dynamite and other high explosives, put up in cartridges, sticks or other forms, suitable for blasting. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
