RE: The tariff classification of marble and travertine tiles, a travertine paver, and travertine mosaics from Turkey.

Dear Mr. Ozer:

In your letter dated May 28, 2014, you requested a tariff classification ruling.

The merchandise under consideration is referred to as item numbers PTIVO12-CLD-Cream, which you state is a tumbled travertine paver designed for outdoor use such as pool decking or walkways; TTIVO12-CLD, which you state is a tumbled travertine tile, designed for indoor use such as flooring and walls; MEPHESUS12-CLD, which you state is a polished marble tile also designed for indoor use as flooring and walls; and MOSIVO2X2-CLD, which you state is a tumbled travertine mosaic designed for both indoor and outdoor use for such applications as fireplaces and kitchen backsplashes. Samples of each item were submitted with your ruling request and were forwarded to the Customs and Border Protection Laboratory for analysis. This analysis has been completed.

Laboratory analysis has determined that PTIVO12-CLD-Cream measures approximately 30.5 centimeters long by 30.5 centimeters wide by 3.1 centimeters in thickness, and is made of calcareous, non-agglomerated travertine which has been simply cut or sawn, does not have beveled edges, and features a honed finish surface; TTIVO12-CLD measures approximately 30.52 centimeters long by 30.52 centimeters wide by 1 centimeter in thickness, and is made of calcareous, non-agglomerated travertine which has been simply cut or sawn, does not have beveled edges, and features a honed finish surface; MEPHESUS12-CLD measures approximately 30.61 centimeters long by 30.45 centimeters wide by 1 centimeter in thickness, and is made of calcareous, non-agglomerated dolomitic marble with a polished surface that has been simply cut or sawn and does not have beveled edges; and MOSIVO2X2-CLD is comprised of multiple calcareous, non-agglomerated travertine arranged in a grid and glued to a woven plastic backing. The sample provided measures approximately 30.5 centimeters long by 30.5 centimeters wide by 1 centimeter in thickness, and features 36 individual squares of approximately 5 centimeters long by 5 centimeters wide. Each square has been simply cut or sawn, does not have beveled edges, and features a honed finish surface. The applicable subheading for item number PTIVO12-CLD-Cream will be 6801.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Setts, curbstones and flagstones, of natural stone (except slate).” The general rate of duty will be 2.8 percent ad valorem.

The applicable subheading for item number TTIVO12-CLD will be 6802.91.2500, HTSUS, which provides for “Worked monumental or building stone (except slate) and articles thereof…: Other: Marble, travertine and alabaster: Travertine: Other.” The general rate of duty will be 2.5 percent ad valorem.

The applicable subheading for item number MEPHESUS12-CLD will be 6802.91.0500, HTSUS, which provides for “Worked monumental or building stone (except slate) and articles thereof…: Other: Marble, travertine and alabaster: Marble: Slabs.” The general rate of duty will be 2.5 percent ad valorem.

The applicable subheading for item number MOSIVO2X2-CLD will be 6802.10.0000, HTSUS, which provides for “Worked monumental or building stone...; mosaic cubes and the like, of natural stone (including slate), whether or not on a backing...: tiles, cubes and similar articles, the largest surface area of which is capable of being enclosed in a square the side of which is less than 7 cm...” The general rate of duty will be 4.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
