RE: The tariff classification of a shredder-feeder-extruder combination machine from Switzerland

Dear Ms. Kreps:

In your letter dated April 22, 2014 on behalf of Next Generation Recyclingmaschinen GmbH, you requested a tariff classification ruling.

The shredder-feeder-extruder combination machine, Model E-GRAN 502, is designed for the recycling of post-industrial or post-consumer plastic waste. Plastic film and film edge trim are shredded directly into the extruder feed section. The conveying area of the screw compresses the material as it enters the extruder where the material is brought to a uniform melt temperature and extruded. The extruder has a dual diameter screw and is available with an extruder screw diameter of 50 mm. The feed section (where the material is shredded), the conveying area and the extruder all lie along a single shaft. The material is subsequently pelletized using either an air pelletizer or a stand-alone pelletizer. The air pelletizer is integrated in the Model E-GRAN 502 whereas the stand-alone pelletizers are said to be connected to the Model E-GRAN 502 by adapters.

The applicable subheading for the shredder-feeder-extruder combination machine, Model E-GRAN 502, imported separately, will be 8477.20.0035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Machinery for working rubber or plastics or for the manufacture of products from these materials, not specified or included elsewhere in this chapter; parts thereof: Extruders … Of a type used for processing thermoplastics: Single screw, with a screw size: Less than 6.4 cm. The rate of duty will be 3.1 percent ad valorem.

The applicable subheading for the Model E-GRAN 502, imported together with its integrated air pelletizer, will be 8477.59.0100, HTSUS, which provides for Machinery for working rubber or plastics or for the manufacture of products from these materials, not specified or included elsewhere in this chapter; parts thereof: Other machinery for molding or otherwise forming: Other machinery. The rate of duty will be 3.1 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on instances where other machines such as the stand-alone pelletizers, air separator, roll feeder, filtration equipment and cyclone silo are imported together with the Model E-GRAN 502. Your request for a classification ruling should include a labelled schematic of the line of machines in its condition at time of importation. Also include detailed information as to the specifications, function and method of operation of these machines. When this information is available, you may wish to consider resubmission of your request.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
