RE: The tariff classification of down rods from China or Taiwan.

Dear Ms. Garcia:

In your letter dated August 21, 2009 you requested a tariff classification ruling. A representative sample was submitted with your request and will be retained by this office.

The product to be imported is described as a down rod for a ceiling fan. This carbon steel welded pipe/tube is available in various lengths, depending on customer preference. Produced with outside diameters ranging from 20.82 mm to 21.33 mm, these pipes can have wall thicknesses from 1.77 mm to 2.15 mm. The down rod has two holes drilled on each end and extends from the ceiling bracket to the top of the fan. These rods may come in a painted or plated finish.

The applicable subheading for the down rods will be 7306.30.5055, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other tubes, pipes and hollow profiles (for example, open seamed or welded, riveted or similarly closed), of iron or steel, other, welded, of circular cross section, of iron or nonalloy steel, having a wall thickness of 1.65 mm or more, other, other, other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
