RE: The tariff classification of three infrared remote control devices from Mexico

Dear Mr. Polkinhorn:

In your letter dated August 5, 2009, you requested a tariff classification ruling on behalf of your client Universal Remote Control, Inc. The samples which you submitted are being retained by this office.

The first item concerned is model UR2-CBL-CV04. This item is a handheld wireless infrared remote control which operates the Scientific-Atlanta Explorer digital set top box. In addition, this remote control is also programmable and can operate a variety of traditional home entertainment equipment. This device operates using infrared technology.

The second item concerned is model UR5U-8700L-TWY. This item is a handheld wireless infrared remote control which operates Scientific-Atlanta, Pioneer, Pace Micro, Samsung and Motorola digital set top boxes. In addition, this remote control is also programmable and can operate a variety of traditional home entertainment equipment. This device operates using infrared technology.

The third item concerned is model MKJ33981409. The item is a handheld wireless infrared remote control which is pre-programmed to operate, and is sold with, LG brand televisions. This device operates using infrared technology.

The applicable subheading for the three infrared remote controls (models - UR2-CBL-CV04, UR5U-8700L-TWY and MKJ33981409) will be 8543.70.9650, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical machines and apparatus…: Other machines and apparatus: Other: Other: Other: Other:. The rate of duty will be 2.6%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
